Terms of Service
These terms are the agreement between you and Adam's Snack Wagon LLC ("Adam's Snack Wagon," "we," "us") when you use our website, app, and delivery service in Oklahoma: across McCurtain County (Broken Bow, Hochatown, Idabel and in between), and in other Oklahoma towns where local restaurants partner with us. By placing an order, you agree to these terms.
1. What we do
Adam's Snack Wagon is a local delivery service. You order food, groceries, and other items from local businesses through us, and a driver picks up your order and delivers it to you. In McCurtain County that's one of our own drivers. In other towns it may be a courier from a delivery company we book for you (such as DoorDash), or the restaurant's own driver. We are the delivery service in the middle — we are not the restaurant or store that makes or sells the items.
2. Placing an order
When you place an order, you're making a request that we and the business fulfill. You agree that the delivery address or map pin you give us is correct and that someone will be available to receive the order. Prices, items, and availability are set by the businesses and can change.
3. Prices, fees, and payment
- You pay the prices shown on our menus, plus a service fee, a delivery fee, applicable sales tax, and any tip you choose. Our menu prices are higher than the store's own counter prices, usually by up to 30%. Our charge on an order is 30% of the food (a little more at the few stores that charge us a card fee). Each store picks how much of that it pays itself, from 0% to 30%, and the rest is built into the menu prices you see. The service fee and delivery fee are shown as their own lines before you pay. Together, this is how we get paid for shopping, driving and running the service. Sales tax is charged on the food only — never on the service fee.
- Payments are processed securely by Stripe, our payment company. By placing an order you authorize the total charge to your payment method.
- Tips go to your driver.
4. Delivery
Delivery time estimates are our best guess and are not guaranteed — traffic, weather, and how busy a store is can affect them. If you use a map pin instead of a street address, our driver follows the pin to your door. Please keep your phone available in case the driver needs to reach you. Cell service is spotty around cabins and the lake — if you have no signal, keep your order page open on Wi-Fi, where you can chat with your driver and send your exact spot.
If we can't reach you. If your driver gets to the address or map pin you gave us and can't reach you, we'll text you, call you, and message you on your order page, then wait 5 minutes. After that, your driver will leave your order at the door with a photo. If the driver can't find the place and you still can't be reached, the driver may keep the order. Orders left or kept this way are not refunded, because the food was made, paid for and driven to the spot you chose.
5. Cancellations and refunds
If something is wrong with your order — an item is missing, incorrect, or there's a problem — contact us as soon as you can and we'll make it right. Once a business has started preparing an order it may not be possible to cancel. Refunds are handled case by case and are issued to your original payment method. Orders we couldn't hand over because we couldn't reach you (see section 4) are not refunded.
6. Age and restricted items
You must be at least 18 years old to place an order. We do not deliver alcohol or tobacco products.
7. The businesses and your food
The restaurants and stores are responsible for preparing your order, for food safety, and for the accuracy of their menus and prices. If you have allergies or dietary needs, please tell us and confirm directly with the business.
8. Drivers
Our drivers ("Snack Drivers") are independent contractors who use their own vehicles. During an active delivery, a driver's location may be shared with you so you can see your order on its way. Location sharing stops when the delivery is complete.
Outside McCurtain County, your order may be delivered by a courier from a third-party delivery company that we book for you, or by the restaurant's own driver. They are not Snack Drivers and follow their own company's rules, but you still contact us about your order and we'll make it right.
9. Acceptable use
Please use our service lawfully and honestly. Don't misuse the service, place fraudulent orders, or treat drivers or business staff abusively. We may refuse or cancel service for misuse.

To the extent allowed by law, Adam's Snack Wagon is not responsible for the quality or safety of the food and items prepared by the businesses, or for losses outside our reasonable control. Nothing here limits any rights you have under Oklahoma law.
